If your marriage VISA runs out before you get your Green Card with conditions how can you travel back to your country of origin or move to another state to attend school or another job. What country is this? If USA, there is no such a thing marriage VISA will be expired! Marriage visa won't expire when your I-485 (adjustment status still pending). You can work with (apply I-765) EAD card and you can renew it every year and also you can travel to your origin country with advance parole documents (I-131 - travel document) and you can move to another state wherever and whenever you want to. However, NOTE that when your I-485 still pending and you move to another state, your case to get a green card will be delayed as well as to your documents will be transferred to your new state and this process takes time!!What happens when your marriage VISA expiresand you do not have your green card ?

I am not sure what your status is. If you have come to the USA under a K-1 visa and have not married within the 90 days, it is time to leave and re-apply with all the attendant fees. You will also have to explain why you did not get married within the allotted time. Good luck with that one.





If you have married and are merely waiting for your GC interview after applying to adjust status, I do not see what your problem is. You are legally present in the country. It is true that you cannot travel out of the country until you get the conditional Green Card, but then you cannot do so once you arrive on a K-1 and before you adjust status. If you anticipated a need to leave the country, you could have applied for advance parole.
You should probably contact an immigration attorney to get the best possible advice.
You are supposed to go back before your visa expires.

Your other posts indicate that you are stuck in a namecheck, and your case can not be approved until it completes. Your elected reps, the USCIS phone staff, the officers at the Field Offices etc.. can do --nothing-- for you. You simply have to wait. While your case is pending, you DO have status here, so you do not have to leave.


If you DO want to leave, you should make sure that you have the appropriate travel documents to not abandon your case, and you should make sure that you do not have any issues that would keep you from re-entering the US.





Some namechecks take years. It's a sad fact of life, but there is nothing anyone can do about it.





If you want to move to another state, you can do that. Take the appropriate steps to change your mailing and case address with the USCIS to continue your case. There is no charge for a change of address.

DO NOT ATTEMPT TO TRAVEL OUTSIDE THE US if this has expired. If it has they will check this and they will not let you back into the US. This just happened to someone in San Jose that I know. She's still in Vietnam and it will take about a year as they had to start all over again.





Call USCIS but they are wrong about 50% I know I check their stuff frequently. You may need to consult with an immigration attorney and there may be a $1000 fine. They can I am sure send you back if they want to.
